Paid Car Park Operating Rules

1. Parking conditions and general information

  • These Operating Rules regulate the mutual rights and obligations of the car park operator, THERMAL-F, a.s., CIN 254 01 726 (hereinafter referred to as the ‘Operator’), and drivers of motor vehicles who will be temporarily using the parking spaces in the car park (hereinafter referred to as the ‘Customer’).
  • The Operating Rules are based on the applicable legislation, in particular Act No. 89/2012 Coll., the Civil Code, as amended, Act No. 361/2000 Coll., on surface road traffic and amending certain acts, as amended by Act No. 19/1997 Coll., on surface roads, as amended.
  • Contract to enter the car park and park in a free parking space: The contractual relationship between the Operator and Customer is always formed for a fixed period of time, either once the long-term parking fee is paid, in which case the relationship is formed for the agreed period of time, or once a motor vehicle is parked in a designated free parking space in the car park, and expires once the concerned motor vehicle leaves the car park or after the expiry of the period for which the long-term parking fee has been paid. The contractual relationship between the Operator and the Customer involves the obligation of the Operator to allow the Customer to enter and park in designated free parking spaces for motor vehicles in the parking area and the Customer’s obligation to pay the Operator the price for the service according to the price list of the Operator’s services as in force. By concluding a contract to enter and park in a designated free parking space, the Customer accepts and confirms they are fully familiar with these Operating Rules and the Operator’s price list.
  • The Operator is not liable for any damage to the vehicle caused by a third party or for any damage to items stored in the vehicle within the meaning of Section 2945 of Act No. 89/2012 Coll., the Civil Code. These operating rules become binding on the Customer and third parties upon entering the car park, it being understood that in addition to the Operating Rules, the car park user is required to follow the Operator’s instructions.
  • The Customer acknowledges that the car park is not a guarded car park.
  • The Customer agrees not to leave the Parking Ticket in their parked vehicle.
  • The Customer acknowledges that in the event of a loss of the parking ticket, they are required to pay a contractual penalty of CZK 2,000 to the Operator.
  • The Customer agrees to pay the parking fee before leaving the car park and to leave the area within 15 minutes of payment.
  • The Operator reserves the right to limit the parking capacity during certain events, especially during the Karlovy Vary International Film Festival, and the Customer is required to respect the Operator’s instructions.

2. The Customer understands that in the car park area, it is forbidden to

  • use an open flame;
  • charge vehicles outside designated charging stations;
  • park vehicles in places with charging stations unless the vehicle is being charged;
  • enter and park LPG vehicles in underground garages;
  • enter the area in vehicles with dimensions exceeding a maximum height of 1.80 m;
  • store and keep items of all kinds, especially items made of flammable materials;
  • fill vehicle tanks, service vehicles, drain and change oil and other operating fluids, wash vehicles, etc.;
  • leave the engine running for longer than strictly necessary;
  • enter and park vehicles with leaking tanks or other damage that endangers the operation of the car park and other users of the car park;
  • enter and park vehicles that are not in proper technical condition, that do not have licence plates or otherwise do not meet the conditions for proper and safe operation on roads;
  • park vehicles outside the designated parking spaces, especially in the lanes, in front of the car park entrance and exit, all due to the risk of disruption of the car park;
  • use roller skates, skateboards and similar devices;
  • organise driving school test drives;
  • place leaflets and other advertising materials behind the wipers of vehicles;
  • consume alcoholic beverages and psychotropic substances;
  • let animals move freely around;
  • leave persons and animals in locked vehicles parked in the car park.

3. Rights and obligations of the Operator:

The Operator is responsible for:

  • traffic signs and traffic organisation in the car park;
  • visible display of the parking service price lists and the Operating Rules;
  • issuing fiscal receipts for parking fees on request;
  • the accuracy and completeness of the parking tax receipts;
  • the Operator is not liable for any damage caused by third parties

The Operator has the right to:

  • require the Customer to comply with their obligations under these Operating Rules;
  • deny a parking place to a vehicle that leaks fuel, oil or other types of liquids or otherwise endangers the cleanliness and safety of the car park;
  • deny a parking place to a vehicle that is not roadworthy or does not have a number plate;
  • deny a parking place to a vehicle that is not properly secured against theft;
  • deny a parking place to a vehicle if the parking spaces are fully occupied;
  • move a motor vehicle that is parked outside a reserved parking space, as well as a vehicle that in any way blocks or endangers the operation of the car park, from one place to another;

4. Customer rights and obligations:

The Customer is required to:

  • familiarise themselves with and follow the Car Park Operating Rules and familiarise themselves with the Operator’s price list;
  • position their vehicles so as not to endanger or obstruct the parking, operating or handling of any other vehicle (or motorcycle);
  • secure the vehicle so as to prevent any damage to it and other property of the Customer or third parties, in particular secure the vehicle against theft, including any items stored therein;
  • only park the vehicle in the places designated for parking; failing that, the Customer agrees that the Operator may move the vehicle to the nearest free parking space by means of a vehicle handling device, it being understood that the Customer is then also obliged to pay the Operator a contractual penalty of CZK 1,000 for each begun day their vehicle is parked outside the designated parking space;
  • in the event of an accident or necessary construction work in the car park, relocate or tolerate the relocation of their vehicle;
  • behave in a polite and correct manner in the car park, in particular avoid damaging the property and equipment of the car park and the vehicles parked in it, it being understood that the Customer is fully liable for any damage they cause to other people’s property in the car park;
  • in the event of damage to another vehicle or the car park, make a report of this to the Thermal Hotel reception.
  • produce a proof of ID at the request of the Operator or a person authorised by the Operator.
